The crux of the controversy stems from a government proposal within the bill: AI developers would be allowed unrestricted access to creative content unless the individual rights holders specifically opt-out. This opt-out model has sparked fierce criticism from many lawmakers, particularly in the Lords.
A significant group where 242 members of the House of Lords opposes the current language of the bill. Their chief concern is the lack of transparency. They argue that AI companies should be compelled to disclose exactly what copyrighted materials they are using to train their systems. Sir Nick Clegg, formerly the president of global affairs at Meta has voiced his support for the government's proposal. He warns that requiring AI companies to seek permission from every copyright holder would effectively "kill the AI industry in this country." On the opposing side stands Baroness Beeban Kidron, a crossbench peer and award-winning film director. She accuses the government of “knowingly throwing UK designers, artists, authors, musicians, media and promising AI companies under the bus.” In her words, failing to protect creators’ intellectual property amounts to "state-sanctioned theft." The UK creative sector, as she noted is valued at an impressive £124 billion — a significant economic force that deserves protection.
Baroness Kidron has proposed a compromise where an amendment would require the Secretary of State for Technology, currently Peter Kyle to report to Parliament on the law’s impact on creative industries within 15 months of it coming into effect.
