With every passing day, the need to implement UCC is arising. Let's know what exactly UCC means.

Legal Status:

Basically UCC is One Nation One Law. It means to have a uniform i.e. a same law for all sections or parts of the society.

Personal Laws:

The personal laws are the law of the different religion made for their affairs of 

  1. Marriage
  2. Adoption
  3. Divorce
  4. Inheritance

These are the laws made from the customs and traditions followed by that particular religion. All the religious have their own ways to practice the above mentioned affairs. There are various source of personal law.

What is UCC?

The Uniform Civil Code is a law through which all these personal laws comes to an end and a law is made for all the civil matters. The Present Civil Laws are made from the cultural values and belief system which were prevailing in the particular religion. 

However, some of the evils of the traditions have been prohibited for i.e. The Sati, Child Marriage and Triple Talaq etc.

But till what extend it is appropriate that in a same land our man gets punished for marrying two girl and the other does not?

When if the man murders someone they are punished equally  and same law is applied. Regardless what their religious says for it.

Herein, the UCC comes in play where all the citizens of India are covered under the same law. It places the individuals on same place.

  • UCC in Indian Perspective: UCC in India is for the uniformity in all civil code.
  • Importance of UCC:  Since the ancient times it is been absence that the women's are facing injustice be it in social status, rights over education or right over the property. Women's since the beginning faces the violence or marriage or divorce.

The changes UCC should likely bring is:

  1. Equal Status to Women 
  2. Abolish Polygamy
  3. All women get equal right before and after marriage
  4. The method of getting divorce will be similar
  5. The Women gets equal right in property of fathers inherited
  6. Abolish Personal Laws
  7. Likely abolishes discrimination for LGBTQIA.

UCC : Political and Legal Aspects

  1. Political Aspects:  In a history of India that a changes or development has to first fight with the barrier of Politics.
    Similarly UCC is also being in Target of Politics. In Indian system vote banks are more over linked with religion or caste based. The UCC is some where related too. There is segment of people who are opposing the UCC. Terming it against there religion practices. The Politics over this matter is somewhere new ending- some terming UCC against them. For some UCC is now a topic of vote bank. Despite the desperate need of UCC in India it has being so politicalised that making people understand is a real time difficulty.

  2. Legal Aspects: India is secular by nature but allows it citizen to practice and follow religious of its own choice.
    Therein, under Article 25,26 and 29th of The Indian Constitution deals with the freedom of religion. Now few people taking shelter under Article 25,26 and 29 talks that UCC violates our right. That fact is that Constitution also talks about Right to Equality under Article 14. Thus even the women's who was getting equal rights would want UCC.

UCC is not violating our right to religion. It does not change our way of marriage or does not stop to practice your believes. It just makes law uniform relating to the matters and just prevents from your rights getting violated. Just like all the religion had there own way to punish the criminals still we have a uniform civil laws i.e. IPC and CrPC. Similarly, we need UCC for civil laws.

Supreme Court in many matters urges with the Government to implement Uniform Civil Code. It Started from the Shah Bano Case where for the first time the need for UCC was strongly felt where the matter related for getting maintenance for her and their children. As her husband gave her divorce after 40 years by Triple Talaq.

From then to Supreme Court stated if to be a need of an hour in few year ago.

Its the constant demand that UCC is important for equality and justice.

Current Status

The Supreme Court rejected a PIL which challenged the formation of Committees for UCC. The Stated like Uttarakhand & Gujarat to forum the Committee to draft UCC.

There was a protest by the opposition party members where the Private members of UCC was introduced in Rajya Sabha. 

Likely in near future, Karnataka State would also form the Committee.
