2. By accessing, browsing or otherwise using or operating the Site/Platform and/or the Services and/or registering and/or signing up on the Site, you acknowledge and agree that:

3. You are entering into a legally valid and binding contract with Intense Intellect Private Limited.

4. These Terms are effective for all users of the Site and the Platform, including but without limitation to Providers of activities.

2. Definition

1. “we”, “our” or “ us” refers to M/s. Intense Intellect Pvt. Ltd its subsidiaries and affiliates and their officers, directors, members, employees, agents or representatives.

2. “You” “User”, “Writer”, “Reader”, “Service Provider”, “Supplier”, “Advertiser”. refers to who accesses or uses the Services for the purpose of sharing, displaying, hosting, publishing, transacting, or uploading information or views or pictures and includes other persons jointly participating in using the Services and shall include any natural or legal person or legal entity who has agreed to become a partner, participant, organiser, sponsor, etc. on the Site or the Platform by providing Registration Data while registering on the Site and the Platform as Registered User using the computer systems.

For the purpose of this agreement it is clarified that the use of word “ You” shall include “User”, “Writer”, “Reader”, “Service Provider”, “Supplier”, “Sponsorer” or “Advertiser”.

2. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of Site/Platform.

3. The domain name www.reflections.live is owned by M/s. Intense Intellect Pvt. Ltd., a company incorporated under the provisions of Companies Act, 2013 amended to date, having it’s registered office at 104- Blue Gaiety, Beegees Co-op. Housing Society, Rambaug Lane No.-5, Kalyan (west), Dist.- Thane, Maharashtra - 421301, India and Branch Office at Office No. C-1, Ground Floor, New Prerna Co. Op. Hsg. Society, New Modi Hyundai Show Room, M. D. Road, Panchpakhadi, Thane (w.) – 400 604 (hereinafter referred to as "Office” or “Offices’).

4. The terms of use set forth below and the policies referred to herein (collectively, the “Terms of Use”) contain the terms and conditions that apply to your use of the services (the “Services”) offered to “You” and others who use the Site/Platform to enrol in activities at or referenced in URL: www.reflections.live and all affiliated websites owned and operated solely by Intense Intellect Pvt. Ltd. (collectively, the ““we”, “ our” or “us” ).

5. When You use any of the services provided by Us through the Site/Platform, You will be subjected to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use.

4. MODIFICATION

1. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to You. It is Your responsibility to review these Terms of Use periodically for updates/ changes. Your continued use of the Site/Platform following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site/Platform.

2. Further, when using the Services, you agree to be subject to any guideline or rules applicable to the provider of the activity you enrolled the applicable child in (such activity provider being referred to herein as, the “Provider of Activity ”).

5. ELIGIBILITY

1. By accessing, browsing or otherwise using or operating the Site/Platform and/or the Services and/or creating an account on the Site/Platform, you represent and warrant that you are 20 years old or older. Anyone under the age of 20 years old is requested to register with us or access or using the Site/Platform or Services only under parental guidance.

2. A child under the age of 13 should use parent’s e-mail id and contact number which will be verified by Us. For verification, the parent will be notified via email having all the details entered by the child. After the verification of parent’s email id and contact number only, the accessibility to our services will be permitted.

3. By creating an account on the Site/Platform, you represent and warrant that you are not a convicted sex offender.

4. Users and Parents should monitor children’s use of the Internet. We do not assume any responsibility for any misrepresentations regarding age when using the Site/Platform or Services. We reserve our right that if the User provided any false information to us, when using the Site/Platform or Services, the User’s membership and account may be terminated immediately in our sole discretion.

6. CREATING AN ACCOUNT AND REGISTRATION OBLIGATIONS

1. In order to search, read, write, upload images, audios or videos on the Site/Platform, you must sign up and create an account online through the Site/Platform.

2. Your account and the information you provide will be subjected to the www.reflections.live Privacy Policy.

3. When creating an account on the site and/or the Platform, you will be asked to create a password. You acknowledge and agree that you will not disclose your password to any third party.

4. You must keep your password confidential and you are solely responsible for maintaining the confidentiality and security of your account, all changes and updates submitted through your account, and all activities that occur in connection with your account.

5. If You use the Site/Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password.

6. If your password has been stolen or hacked into, please immediately contact at contact@reflections.live .

7. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Site/Platform and refuse to provide You with access to the Site/Platform.

8. You may not impersonate someone else, create or use an account for anyone other than yourself, provide an email address other than your own, create multiple accounts or posting blogs or articles except as otherwise authorized by us, or provide or use false information for any account and posting blogs or articles held or organised on the site/Platform. You acknowledge that any false claiming/listing of an activity on the site/Platform that may cause Us or third parties to incur any economic damages and losses in that event you shall be held liable and accountable for such losses and/or economic damages.

9. By creating an account, you can register and enrol yourself for reading, writing of blogs or articles, upload images, etc. on the Site/Platform.

10. You represent and warrant that all information, statements and content you provide or make, as applicable, when creating an account, as well as all other information, statements and content you provide or make, as applicable, are true, accurate and correct.

11. Your mobile phone number and/or e-mail address is treated as Your primary identifier on the Site/Platform. It is your responsibility to ensure that Your mobile phone number and your email address is up to date on the Site/Platform at all times. You agree to notify Us promptly if your mobile phone number or e-mail address changes by updating the same on the Site/Platform through a onetime password verification.

12. You agree that We shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under your display name in cases where You have failed to update Your revised mobile phone number and/or e-mail address on the Site/Platform or when there is data breach from thirty party or any sort of hacking or any related activity.

13. You, hereby, agree to be solely responsible for learning of and confirming all holidays and known activity closings with the applicable Provider. We have no responsibility for informing you of any activity closings or holidays.

7. OTHERS TERMS

1. You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

2. You agree to use the data owned by Site/Platform (as available on the Services or through any other means like API etc.) only for personal use/purposes and not for any commercial use (other than in accordance with claiming/listing of an activity access) unless agreed to by/with Us in writing.

You agree not to access (or attempt to access) any of the Services by any means other than the interface that is provided by Site/Platform, unless you have been specifically allowed to do so, by way of a separate agreement with Us. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including use of scripts or web crawlers) and shall ensure that you comply with the instructions set out in any robots.txt file present on the Services.

4. You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services). You shall not delete or revise any material or information posted by any other User(s), shall not engage in spamming, including but not limited to any form of emailing, posting or messaging that is unsolicited.

8. COMMUNICATIONS

1. 1. All software used on the Site/Platform is the property of M/s. Intense Intellect Pvt. Ltd or its software suppliers and protected by India and international copyright laws and other applicable laws.

2. We also own the Site/Platform, the trademarks, service marks and domain names displayed on the Site/Platform (unless otherwise noted), whether registered or unregistered, and all Blogs, Articles, text, logos, photographs, graphics, images, music, software, audio, video, location data, information or other materials, and all other forms of data or communication (other than your Content (as defined below) and any other Content supplied to us by third parties) (collectively, the “ Our Content”) and the Our Content is protected by copyright, trademark, and other laws of the India and foreign countries.

3. You represent and warrant that you will not remove, alter, conceal or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Site/Platform nor shall you use, sell, transfer, reproduce, download, distribute, publicly display, edit, publish, copy, print, license or create derivative works from any of the Our Content without Our prior written consent.

2. License to Your or User Content

1. 11. CHARGE

1. We reserves the right to charge a user for booking a trial activity on our site in order to ensure to the Provider running the activity that the user intends to attend such activity and as compensation to us for the use of our site to find and book and be reminded about such trial activity.

2. In particular, We may at our sole discretion introduce new services and modify some or all of the existing services offered on the Site/Platform. In such an event We reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy shall be posted on the Site/Platform and such changes shall automatically become effective immediately after they are posted on the Site/Platform. Unless otherwise stated, all fees shall be quoted in Indian Rupees. You shall be solely responsible for compliance of all applicable laws including those in India for making payments to Us.

3. Refund and Cancellation policy, the users will only subscribe to the paid model after reading and agreeing to our terms and conditions. Thus, the question of refunding any subscription money received does not arise.

12. PROHIBITED USES, CONDUCT AND CONTENT

1. You shall be liable for any illegal or unlawful use of the Site/Platform or the Services or any use of the Site/Platform or the Services prohibited by these Terms of Use. By accessing the Site/Platform and using the Services you agree to comply with all applicable laws.

5. harasses or advocates harassment of another person;

6. involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";

7. promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

8. infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity];

16. solicits gambling or engages in any gambling activity which We, in Our sole discretion, believes is or could be construed as being illegal;

20. infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products;

21. violates any law for the time being in force;

22. deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

23. impersonate another person;

24. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;

25. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation ;

26. shall not be false, inaccurate or misleading;

27. shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force; and

28. shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or other suppliers.

29. Violate these Terms of Use.

2. Use the Site/Platform in such a way that could damage or impair another party’s or entity’s use of and access to the Site/Platform.

3. Attempt to gain unauthorized access to the Site/Platform or interfere with, modify, or restrict in any manner or form any features of the Site/Platform or the Site/Platform itself.

4. Attempt to breach any security or authorization measures of the Site/Platform.

5. Attempt to scrape, retrieve, or use other automated means (including any robot, scraper or spider) to access the Site/Platform, the Services or any of Our Content.

6. Use or display any of Our Content without Our the prior written consent.

7. Use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site/Platform or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site/Platform or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site/Platform. We reserve Our right to bar any such activity.

Attempt to gain unauthorized access to any portion or feature of the Site/Platform, or any other systems or networks connected to the Site/Platform or to any server, computer, network, or to any of the services offered on or through the Site/Platform, by hacking, password "mining" or any other illegitimate means.

Make any negative, denigrating or defamatory statement(s) or comment(s) about Us or the brand name or domain name used by Us or otherwise engage in any conduct or action that might tarnish the image or reputation, of service providers or providers of activity on platform or otherwise tarnish or dilute any person's trade or service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by Us.

11. Take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site/Platform or internal systems or networks, or any systems or networks connected to the Site/Platform.

12. Use any device, software or routine to interfere or attempt to interfere with the proper working of the Site/Platform or any transaction being conducted on the Site/Platform, or with any other person's use of the Site/Platform.

13. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal You send to Us on or through the Site/Platform or any service offered on or through the Site/Platform. You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity.

14. Use the Site/Platform or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of M/s. Intense Intellect Pvt. Ltd and / or others.

13. REPRESENTATIONS AND UNDERTAKING OF THE USERS

1. You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Goods and Service Tax, Income Tax, Octroi, Custom Duty, Local Levies) regarding Your use of Our service and Your listing, purchase, solicitation of offers to purchase, and sale of products or services.

2. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force.

3. You shall not engage in advertising to, or solicitation of, other Users of the Site/Platform to buy or sell any products or services, including, but not limited to, products or services related to that being displayed on the Site/Platform or related to us.
